Terms of service

1. Scope and operator
2. Services
The platform allows owners to offer domains (buy now, make offer, auction, lease-to-own), individually or as a package of several domains, to run sales pages and to settle sales through an escrow procedure. The operator does not become a party to the purchase contract between buyer and seller unless it sells itself, in its own name on behalf of an owner (consignment), or under Escrow Plus (section 6a). If the seller chooses a service model in which the operator handles communication, the operator acts as an intermediary on the seller’s behalf.
2a. Packages
Several domains may be offered as a package. A package is sold as a whole; individual domains from it are not separately available while the package is listed. Price, included domains and any reservations follow from the package page at the time the contract is concluded.
2b. Sales by office holders
Anyone realising third-party assets, in particular an insolvency administrator, may offer here by virtue of office. They evidence their appointment by the court order or certificate of appointment; such an offer is not published before that has been checked. They warrant that they are entitled to realise the assets. Where the sale is subject to an approval, for example by a creditors’ committee, this is stated on the offer page; the contract becomes effective only once the approval is given, failing which any amount already paid is refunded in full.
3. Account and identity
Buying, selling and bidding require an account with truthful information. The operator may require identity verification at any time, in particular before payouts or for larger amounts, and may hold transactions until it is completed. Login credentials must be kept confidential.
4. Sellers’ obligations
Sellers warrant that they own the domain and are entitled to dispose of it, that to their knowledge it does not conflict with third-party rights (in particular trademark and name rights), and that upon a sale they will transfer it on time and free of encumbrances. Information about the domain (e.g. age, traffic, revenue) must be accurate. Sellers indemnify the operator against third-party claims based on a breach of these obligations.
4a. Continued availability
This warranty applies not only at listing but for the whole time the domain is offered here. Anyone who sells, transfers, surrenders or allows a listed domain to lapse elsewhere must withdraw it from the listing without delay or inform the operator. If they do not, and a purchase contract is concluded that cannot be performed, the seller is liable to the buyer; the operator is not a party and owes no compensation in that respect unless it is itself the seller under section 2 or 6a.
4b. Ongoing checks
The operator checks listed domains regularly and automatically: publicly available registry data (including registrar, creation date, status, expiry date) and the DNS proof provided when the domain was connected. If there are indications that a domain is no longer at the seller’s disposal, the operator may remove it from the marketplace without notice and refuse a pending purchase until the situation is clarified. The seller is informed. Where a registry does not publish an expiry date, the operator may require the seller to state it; that statement counts as the seller’s information within the meaning of section 4.
4c. Confirmation of a sale
The operator may require the seller to confirm a sale by an entry in the domain’s DNS zone containing the transaction and the purchase price as a checksum. This confirms control over the zone at the time of the entry, not ownership of the name. Until it is in place a payout may be withheld; the purchase contract and the buyer’s rights are unaffected.
5. Offers, acceptance, conclusion of contract
Listing a domain in the marketplace is not yet a contractual offer but an invitation to make one. By clicking “Buy” and confirming, the buyer makes a binding offer at the price shown. The purchase contract is concluded only upon confirmation by the platform, declared on the seller’s behalf, once it has been checked that the domain is still at the seller’s disposal and can be transferred (section 4b). That check is normally immediate. If it is negative, no contract comes about and any amount already paid is refunded in full. The buyer’s claims against the seller for the failed transfer are unaffected; the operator is not a party in that respect. Offers and counteroffers are binding until they expire (7 days). If the seller has set a floor price, an offer at or above it is deemed accepted immediately on the seller’s behalf; below it, the system may make a counteroffer on the seller’s behalf. Every purchase is settled through escrow.
6. Prices, fees, taxes
The prices, fees and commissions displayed at the time of the transaction apply. The seller decides per domain who bears the escrow fee (seller, buyer, or half each); the setting at the start of the transaction governs, and it is shown before the contract is concluded. VAT is charged where due under the law of the operator’s seat and of the recipient; the operator issues invoices or credit notes accordingly. Users are responsible for their own tax obligations.
6a. Escrow Plus
At the request of one side, the operator steps into the chain of contracts: it acquires the domain from the seller and sells it to the buyer, so that the other side does not learn the name of its counterparty. In that case the operator is a contracting party, issues the invoice in its own name and settles with the unnamed side by credit note. In return the commission increases by the surcharge shown. Each side makes this choice itself; it is recorded when the transaction starts and continues to apply unchanged for that transaction.
7. Service models and subscription
Sellers choose whether they communicate with prospects themselves or the operator does so (commission or monthly subscription). The subscription renews monthly and can be cancelled at any time with effect from the end of the paid period. If a payment fails, the “self-service” model applies again after a grace period of 7 days.
7a. Account, credit and chatbot
Notwithstanding sections 5 and 7: the account and listing domains are free of charge; there is no membership and no basic fee. The first 500 domains per account are free; for each further domain € 0,50 is charged once from the credit when it is added. A commission applies only to a sale settled through escrow.
AI texts and the negotiation chatbot are paid from prepaid credit. Billing is based on the tokens reported by the AI interface at the price per 1,000 tokens shown in the account. Every booking appears with tokens, amount and domain in the account log. Unused credit is refunded on request when the user relationship ends.
Sellers choose per domain: (1) they negotiate and handle payment and transfer themselves; (2) the chatbot negotiates on their behalf until agreement, and they handle payment and transfer themselves; (3) the chatbot negotiates and the sale is settled through escrow with a commission of 9,5 %, from a price of € 10.000 and after rating and approval by the operator. The chatbot may make binding commitments on the seller’s behalf, but never below the floor price set; the buyer additionally confirms an agreement by email. In cases (1) and (2) the operator does not become a party to the settlement; after an agreement both sides receive each other’s contact details. A one-off fee of € 10 is charged to the credit for reviewing a proposal. It applies only when the proposal goes to review by the operator; proposals rejected by the automatic rating are free of charge. The fee covers the review and is not refunded if the proposal is declined.
8. Sales pages and content
The operator may create sales pages for listed domains, generate texts (including with AI), logos and designs, and adapt or remove imported content where this serves the sale or is legally required. Users grant the operator the necessary rights to content they supply and warrant that they are entitled to do so.
8a. Publication of completed sales
Completed sales are published with domain, amount and month, without the names of those involved. The seller can switch this off in advance for future sales and afterwards for each individual sale. Where the parties agree to keep the price confidential, the seller must switch publication off.
9. Prohibited use
Prohibited in particular: fake bids and offers, circumventing the platform to avoid fees on deals initiated through it, domains with unlawful content or obvious infringement of third-party rights, money laundering, and use by persons subject to sanctions binding on the operator. The operator may block content, suspend transactions and close accounts; ongoing escrow transactions are properly completed or refunded.
10. Liability
The operator provides the platform and the escrow procedure. It acts as an intermediary between buyer and seller and does not become a party to the purchase contract; performance of that contract, in particular the transfer of the domain, is the seller’s responsibility alone. This does not apply where the operator expressly sells or buys itself (consignment, Escrow Plus); there it is liable like any other contracting party. For its own services, namely the safekeeping and payout of funds held in escrow, it is liable in accordance with the following paragraphs; that liability cannot be excluded.
The operator is liable without limitation for intent and gross negligence and for injury to life, body or health. For slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage and otherwise excluded. The operator is not liable for the accuracy of users’ information, the value of a domain, or acts of registrars and registries.
11. Term and termination
The user relationship runs for an indefinite period and may be terminated at any time; open transactions are completed. The operator may terminate without notice for good cause, in particular for breaches of section 9.
12. Changes
The operator may amend these terms with effect for the future. Each version carries a version number; for every transaction the accepted version is recorded. Ongoing transactions remain subject to the version in force when the contract was concluded.
13. Governing law, venue, language
the law of the State of Wyoming (USA) applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country of their habitual residence. The place of jurisdiction for merchants and legal entities is Sheridan County, Wyoming (USA). The German version is authoritative; translations are for information.
14. Severability
Should any provision be invalid, the validity of the remaining provisions is unaffected.
